Fairytale Bride Terms and Conditions: These are the terms and conditions on which we, Fairytale Bride (“we” or “us”), supply products to you (“the Customer” or “you”). The latest version is available on our website and a copy will be provided to you at the point of ordering. 

1. Why you should read them. Please read these terms carefully before placing an order, as they form part of a legally binding contract. “Writing” includes emails, text messages, WhatsApp and social media messages. It is your responsibility to inform us of any changes to your contact information. Information about us and how to contact us. We are ‘Fairytale Bride’, trading from our premises located at ‘41 London Road, Lexden, Colchester, Essex, CO3 9AJ’. To contact us, please write to us at the above address, telephone ‘01206 484121’ or email ‘hello@fairytalebride.co.uk’. 2. Our contract with you. How we accept your order. A legally binding contract comes into existence when you have paid the agreed deposit or full payment of your order. Deposits are non-refundable and cannot be transferred to another person or item. If we cannot fulfil your order due to discontinuation, unavailability, an error in pricing or description or any other reason, we will inform you, refund any payments made and will not be liable for breach of contract or compensation. This contract is between you and us only. No other person has any rights under this contract. 3. Placing your order. Paying a deposit or full payment is a commitment to fulfil all outstanding payments. All dresses are made to order and not made to measure; they are made according to the designer’s standard size charts. Your dress is made especially for you to your order size. You must check and confirm your measurements when signing your order. We are not responsible if the dress does not fit due to weight changes or other
factors (e.g. pregnancy). If you delay measurements, it is your responsibility to ensure they are taken in time for ordering and delivery. 3a. Alterations. All dresses will require alterations, which are your responsibility. No alterations are included in the price. 3b. Bespoke changes and surcharges. Any dresses requiring extra length, a curvy surcharge, rush orders or bespoke changes may incur additional charges. Where the cost is not known at the time of ordering, we will confirm the price once received from the designer. You must approve these charges in writing (email or signed form) before bespoke changes are made. If you do not approve, the bespoke changes will not be made and your final balance will reflect only the agreed items. Once approved, the charge must be paid in full before the dress is
released for collection. If you later change your mind after approving, you are still responsible for the bespoke charge. 3c. Off-the-peg and ex-sample dresses. Full payment is required and dresses are removed from sale pending collection. Known faults will be disclosed but you are responsible for inspection prior to purchase. Wear and tear from previous try ons is a factor. We will try to clean visible marks but cannot guarantee removal and are not held responsible for any stubborn marks. Any cleaning or alterations are your responsibility and at your own cost. 3d. Bridesmaids and accessories. Deposits are not taken. These products must be paid in full at the time of ordering, unless ordered with a wedding dress. 3e. Cancellations. We do not accept cancellations of your order for
whatever reason and any monies paid will not be refunded. Failure to pay the remaining balance will be considered a breach of contract and we reserve all rights in this respect. Please ensure all items ordered are suitable for your requirements as we cannot refund, exchange or replace items. Including those that are returned as unsuitable or do not fit. Any items cancelled after an order has been placed with us will be subject to the full amount being immediately payable. We will not be held in breach of contract for events beyond our reasonable control, including but not limited to, acts of God, war, riot, civil commotion or terrorist attack, malicious damage, any national or international pandemic, compliance with any law or governmental order, accident, fire, flood, or storm, venue cancellation or personal circumstances. We strongly recommend that insurance be taken out for such unforeseen circumstances. 4. Terms for Online Orders and Distance Selling. If you place an order with us by telephone, online or from any location away from our shop premises, the following applies: Bespoke or Made-to-Order Items: These items, including bridal and bridesmaids’ dresses, veils and accessories made specifically for you, cannot be returned, exchanged or refunded unless they are faulty. Off-the-Peg / Ex-Sample Dresses: These may be returned, exchanged or refunded only if faulty, unless otherwise stated at the time of purchase. Return Requirements if Faulty: If an item is faulty or damaged, please contact us immediately by email (hello@fairytalebride.co.uk). Any faulty item returned must be unused, in the same condition it was received, with original packaging, box and labels intact. Please do not send items back to the manufacturer. Return address: Fairytale Bride, 41 London Road, Lexden, Colchester, Essex, CO3 9AJ. Once received and inspected, we will notify you of the outcome and process any approved refund to the original payment method. This does not affect your statutory rights. 5. Product descriptions. Products may vary slightly from images online, in brochures, social media, in store samples, swatches or other promotional materials. All dresses are made from a combination of various fabrics, making it impossible to guarantee the absence of minor imperfections on the garments and likewise, through the process of adornment/embellishment, no two dresses
are the same. We shall not be liable for any claim arising from any dissimilarity or disparity in shade, tone or positioning of different fabrics or jewels. 6. Providing the product. When you place your order, we will give you an estimated delivery date based on the wedding date given and are for guidance only. We cannot
guarantee delivery by a fixed date. We are not responsible for delays outside our control, including postal or designer delays. In the event of delays, we will contact you and offer alternative in stock dresses or options where possible. We are not liable for such delays but if there is a risk we cannot fulfil your order by your wedding, you may cancel and receive a refund for any products not received. 7. Final Payment, Collection & Storage. As your dress nears completion, we will notify you that it is ready to be released by the designer. This is when your final balance must be paid in full. No goods may be released, collected or removed from the premises until full payment has been received. Ownership of the goods passes to you once full payment has been received. Once notified your order is ready,
collection must be arranged within 4 weeks, unless otherwise agreed in writing. You are responsible for inspecting your products at the time of collection. Any concerns or issues with a Made to Order dress/products must be raised within 7 days of collection. If a dress is not collected within 4 weeks of notification and no prior arrangement has been agreed, a charge of £15 per week will be added to your account. If, after reasonable attempts to contact you, any Order remains unpaid, uncollected or storage charges remain unpaid for a period of 3 months, the Order may be treated as abandoned. In these circumstances, we reserve the right to resell or otherwise dispose of the item. Any monies already paid will not be refunded. Failure to collect your order or pay outstanding amounts is considered a breach of contract and you will remain liable for the full balance, including any loss of profit. Storage. Paid for dresses may be stored with us for a fee. Storage is only available once the bride has attended the boutique and tried on/inspected her dress. Please contact us for current storage fees and availability. During storage, in the unlikely event that a paid for product is lost or damaged due to fire, flood or theft whilst on our premises, Fairytale Bride’s liability will be limited to reimbursement of the retail cost of the product only. We accept debit and credit cards and bank transfers. We do not accept payment by cheque or American Express. 8. If there is a problem with the product. If you have any questions/complaints about the product, please contact us (section 1). We hope your product is as expected and without fault. Contact us as soon as a fault is noticed. We will deal with the matter as soon as possible and in accordance with your legal rights. 9. Third Party Services. Once your order is collected, our contractual obligation is fulfilled. We do not provide an alteration service and any alteration costs are your responsibility. We can provide contact details for external alteration and garment cleaning specialists upon request but this is not a recommendation and we have no control over these third parties. We accept no responsibility or liability for the performance of any third-party alterations or cleaning services. Any disputes or issues with these services must be resolved directly between you and the specialist. It is your responsibility to ensure that you have booked your first fitting with any external alteration specialist sufficiently in advance of your wedding. 10. Care and Use of Products. Your order is a delicate item and should be handled with extreme care. We are not liable for any damage during or after the wedding, including fair wear and tear, wilful damage, accident, negligence by you or any third party or failure to follow our care instructions. We are not responsible for any issues caused by incorrect use, damage from unsuitable accessories, shoes, underwear or any items affecting the product’s structure or condition. All dresses are ceremonial and intended for ceremonial use only. We are not liable for any loss or damage occurring after the wedding ceremony. 11. Personal Information. We will handle your personal data in accordance with our Privacy Policy, which explains how we collect, store and use your information. By placing an order, you agree that we can contact you about your wedding and share necessary details with designers to fulfil your order. 12. Other Important Terms. These terms form a contract between you (the person who signs) and Fairytale Bride only; no other person has any right to enforce them. We may transfer our rights and obligations under these terms to another organisation if needed, and you may only transfer your rights or obligations if we agree in writing. If any part of these terms is found to be invalid, unlawful or unenforceable, the remaining terms will continue to apply in full. These terms are governed by English law and any legal action relating to your order must be brought in the courts of England and Wales. 13. Updates to Terms. We may update these terms from time to time. The latest version is always available on our website. You should check the terms occasionally to ensure you are happy with any changes. 14. Acknowledgement. By placing an order and signing an order form, you confirm that you accept these terms, agree to pay for the items you have ordered and acknowledge that all garment sizes are correct.
